January 13 (Location: Iredell County Sheriff’s Office) Service of Process Fundamentals

10:00 a.m. to 2:30 approximately

Description: This presentation focuses on legal essentials for basic service of process. Focus is on “Rule 4” of the N.C. Rules of Civil Procedure, which is
the statute that governs what courts consider legally valid “service by the Sheriff” (N.C. Gen. Stat. 1A-1). Civil summonses are the central topic, but the
service principals apply to many other civil papers equally. Civil summons emphasis is on proper identification of defendant legal “categories,” including
an overview of ‘natural person’ defendants, plus sole proprietorships, corporations, partnerships, limited partnerships, Limited Liability Companies,
Limited Liability Partnerships (and such related terminology as “d/b/a/, t/a/, Ltd., Company, Co., Inc. LLC, PLLC, PC, PA,” etc.) and service requirements
for each. Discussion includes basic risk management concepts, negligence as regards failure to achieve proper service, and risk-management strategies
to protect the Sheriff.
